The exempt development saga:
Much confusion and miss-representation exists regarding development approvals, exempt development and building approvals. Many clients have received advice that their project is exempt “so why do I need building approval?”
To clarify there are 2 types of exemption, one being exempt from development approval whereby you’re essentially “asking for permission ” also known as a development application and the other, building approval, whereby a private certifier deems your project to be in accordance with all the planning rules however requires certification that the project is also constructed to current building code requirements.
The exempt building approval relates to many structures and additions like pergolas, carports, and sheds of a particular size which you can build at any time. There are specific constraints regarding block size, the size of the structure and maximum heights and spans.
